Wii Includes Free Opera Browser, Gets Sued!

As one of my favorite characters put it perfectly: "It is inevitable," agent Smith, the Matrix Trilogy.

I couldn't agree with you more Smith, we all had to see this one coming. Wii is being sued over its controller by Green Welling LLP in the U.S. District Court of the Western District of Washington.

You know by now that the wireless remote controller has been falling out of the hands of excited gamers and flying all over the house causing damages and so on. Just a few days ago, Nintendo tried to manage some damage control by exchanging 3.2 million Wii remote straps with better ones.
Well, according to the law firm doing the suing, it's not enough.

"Nintendo's failure to include a remote that is free from defects is in breach of Nintendo's own product warranty," says a statement on the law firm's site.
Poor, poor Wii, so successful yet so hated by lawyers. You know, the only ones who will be happy by this are PS3 and Xbox.

At the same time, Nintendo and Opera Software are teaming up to bring the Internet to the living room! A free beta version of the Opera Web browser will come in handy as Wii owners who are connected can activate the Wii Shop Channel and can download a free beta version of the Opera browser to activate the Internet Channel of the Wii Menu and begin surfing the Web.
So now the Wii just got handier for non-gamers.

Let’s hope the websites don't come flying out of the screen!

    It's funny that no-ones thought to sue car manufacturers yet since cars are crashing all the time and people get hurt. I mean afterall the fact they included airbags is a clear admission they are aware of the danger the product poses.

    This is why the rest of the world laughs at America.

    Good you stupid bloody Americans you have to sue everything don’t you - it's a short coming of your culture that innovative but yet inevitably ‘un-cotton wrapped’ objects of use have to be subjected to a barrage of litigation culminating in its withdrawal - ruining the fun for all, well pat yourself on the back uncle Sam - for ruining it for yourselves, like smoking in public places, drinking over 18, etc, on the flipside how dangerous is a wii compared to a gun, wake up you idiots…

    Speaking as an American, I am highly offended at the accuracy of your comments. Never before has America been so fairly insulted. Some people resort to childish name-calling, but not you! No, you had to hit the nail on the head succinctly. So what if our justice system is a crude mockery, and having the word "justice" in there is almost laughable? Did you really have to point it out?
    British people are all gay! I win! You know why? Because Americans are generally too stupid to know when they've lost! Now I'm going to go back to my trailer park and eat 5 Big Macs!

    (I really am an American. I also really hate many of my "countymen.")

    Wii is being sued over its controller by Green Welling LLP. I was wondering who is really behind the lawsuit. Is it solely from the consumers or the lawyers? If the lawsuit is engineered by the lawyers, then I wound suspect that someone is using the U.S. justice system to try to make some money off Nintendo. Someone should really do research on Welling LLP to see whether it has any previous dealings of this type of allegation, or it has any connection with Microsoft or Sony in any way.

    Just for info sake, attorneys need a client. They cannot start a lawsuit without one. Green Welling specializes in representing consumers & investors in class action lawsuits according to their website. So one guy goes to see them and they go looking for other people to join, which is easy due to all the flat screen TV posts & everyone splits the proceeds on the win.

    The point of this lawsuit is that Nintendo is supposedly providing a safety device. It is intended to prevent the controller from flying across the room in the event that it accidentally slips. It is not like "accidentally" dropping a Dell on your foot. It's more like your seat belt or airbag failing in an accident and you go flying through the windshield. The car isn't supposed to hit another car, but it does happen and that is why the airbag seat belt are there. That is the same reason the strap is there, otherwise there wouldn't be a reminder to put it on. It has only one purpose and it fails. Sounds like defective equipment to me.

    According to the lawsuit, it states: "The lawsuit also seeks an injunction that requires Nintendo to correct the defect in the Wii remote and to provide a refund to the purchaser or to replace the defective Wii remote with a Wii remote that functions as it is warranted and intended."

    If the strap is defective, replace the strap. If the seatbelt is defective, replace the seatbelt. Why do you demand to replace the whole car if only the seatbelt is defective?

    It sounds like that the lawyers want to buff Nintendo, trying to get away with more compensation than reasonable. Sounds like a money grapping lawsuit to me.
